Biography

Over the past thirty years, Mr. Chamberlin has achieved the resolution of hundreds of matters. Over the past five years, he has brought that experience to the mediation arena. Mr. Chamberlin has successfully mediated dozens of cases involving personal injury matters, insurance coverage matters, construction defect matters, and employment matters. Mr. Chamberlin's experience representing insurance companies in some of the largest and most important cases across the nation gives him the knowledge and contacts to be able to have frank, direct discussions with insurers regarding exposure, valuation and quick reoslution of matters. He has been sought out by both plaintiffs/policyholders and defendants/insurers for his mediation skills. Mr. Chamberlin prides himself on achieving cost-effective resolution and affecting a mutually beneficial settlement for all parties.

In addition to acting as a mediator, Kirk specializes in business litigation, real estate matters, insurance coverage and complex multi-party litigation. He has experience in handling a wide range of complex matters, including general liability, directors and officers liability, environmental, employment and asbestos. Kirk has participated in all activities association with such litigation from pretrial through trial. He acted as lead trial counsel in the Western MacArthur Co., etc., v. US Fid. & Guar. Co., et al. coverage litigation which presented in excess of $6 billion in alleged asbestos liability, as well as compex insurance and 524(G) bankruptcy issues. In addition, Kirk is a Certified Litigation Management Specialist with training in Litigation Metrics and Alternative Fee Arrangements and is committed to providing efficient legal services.

Kirk also has extensive appellate experience, including legal briefing and oral argument before numerous California Court of Appeals, the 9th Circuit (Custom Ins. Co. v. Space Systems/Loral, et al., Ninth Cir., Case No. 11-16272), the California Supreme Court (Foster-Gardner v. National Union, et al.; considered one of the most important insurer opinions of the decade) and the Texas Supreme Court (Federal Ins. Co. v. Samsung Electronics America, et al; Zurich Amer. Ins. Co., et al., v. Nokia Inc.)

In the area of business litigation, Kirk has represented Officers and Directors in business dissolution matters and intellectual property. Kirk has also acted as counsel in employment disputes. With respect to mediation, Kirk has been instrumental in successfully resolving complex multimillion dollar matters.

Kirk is the head of the real estate department at Chamberlin & Keaster LLP. He is also licensed as a real estate broker in California. The real estate department represents financial institutions, property development companies and other business entities in all real estate matters, including transactional and litiagation matters.

Kirk received his Bachelors of Arts in Economics from Indiana University (Dean's List) in 1984, and his Juris Doctor degree, with distinction, from the University of Iowa in 1987. He is a member of the Environmental and Litigation Sections of the Los Angeles and American Bar Associations and the Litigation, Real Estate and Commercial Law Sections of the State Bar of California.

Kirk has written and lectured in the areas of Insurance Coverage and Defense, Bad Faith, and Cost Effective Case Resolution. These topics include: "Reimbursement of "Non-Defense" costs," "A Survey of California Law: Real Answers," "Nationwide Survey of Independent Counsel Rules in Reservations of Rights Conflict Situations," "A Nation-wide Survey of Defendant and/or Indemnity Obligations in Administrative Action Settings," " Cumis Counsel" and "Unfair Claims Practices Regulations," and "Climate Change: Recent Developments - Claim and Coverage Implications."
